Consultation for Extending Cost Recovery

The HSE is consulting on proposals for extending its powers to recover costs for enforcement action where there is non-compliance.  The Scotch Whisky industry's safety record and pro-active approach to health & safety and the environment has been widely recognised.  The industry has very few incidents and is now safer than ever due to improved management systems and advances in the understanding of hazards and the technical control of them.  The SWA's response emphasises that the proposals should only apply to material breaches and that companies should not be faced with fees for minor technical breaches.  The HSE must also guard against incentivising longer inspections or fault-finding for revenue raising purposes.
