Australia trademark

09 Jun 2014

In March 2014, the SWA successfully registered "Scotch Whisky" as a certification trademark in Australia.  The rules for use of the certification trademark have been amended.

In particular, rule 12(e) has been amended to:

"Approved users may not…….. apply to register any mark in Class 33 containing the words "Scotch Whisky" or "Scotch" unless the specification of goods is limited to "Scotch Whisky" or, where appropriate, "Scotch Whisky Liqueurs" or "Scotch Whisky mixed drinks".

This notice fulfils the requirement under the rules to advertise any amendment to the rules on the Scotch Whisky Association's website.
